Introduction

Welcome to Hanzi Flow ("the Application"). These Terms of Service ("Terms") govern your use of the Application. By accessing or using the Application, you agree to be bound by these Terms.

1. User Responsibilities

1.1 Account Security

  • You are responsible for maintaining the confidentiality of your login credentials.
  • Notify us immediately of any unauthorized access or use of your account.
  • You agree to take full responsibility for all activities that occur under your account, whether authorized or unauthorized.

1.2 Prohibited Conduct

  • Do not use the Application for illegal or unauthorized purposes. You may not:
    • Upload content that violates third-party rights or applicable laws.
    • Engage in abusive or harassing behavior, including but not limited to sending spam or offensive content.
    • Attempt to gain unauthorized access to the Application or its servers.
    • Use the Application to distribute malware or viruses.
    • Misuse the platform for automated data scraping, bulk data collection, or attempts to circumvent security features.

2. Subscription and Payment Terms

2.1 Plans and Features

  • The Application offers multiple subscription plans, including a free tier and paid tiers with enhanced features.
  • We reserve the right to modify or discontinue any subscription plans at any time, with notice to users as appropriate.

2.2 Billing and Payment

  • All payments are securely processed through Stripe, Inc. ("Stripe"), our third-party payment processor. By purchasing a subscription, you agree to comply with Stripe's Terms of Service and Privacy Policy.
  • You must provide valid and up-to-date payment information to subscribe to a paid plan.
  • Subscription fees are billed on a recurring basis according to the selected plan, unless canceled before the next billing cycle.
  • If your payment method is declined or fails, Stripe will attempt to process the payment again. If payment is unsuccessful, your subscription may be suspended or terminated.

2.3 Cancellation, Refunds, and Chargebacks

  • All subscription payments are final and non-refundable, except as required by applicable law.
  • You may cancel your subscription at any time, but you will retain access until the end of the current billing cycle. No prorated refunds will be provided for unused portions of the subscription period.
  • In the event of a chargeback or payment dispute, your access to paid features may be suspended until the dispute is resolved. We reserve the right to terminate your account if fraudulent chargebacks are detected.

2.4 Payment Security and Data Handling

  • We do not store or process your payment information directly. All transactions are handled by Stripe using industry-standard encryption and security measures.
  • By using our services, you acknowledge that Stripe is responsible for the processing and security of your payment data.

3. Data Storage and Processing

  • By using the Application, you acknowledge that your data may be stored and processed on servers located in the United States.
  • We take appropriate measures to protect your data, and where required, we comply with applicable data protection laws, including the use of Standard Contractual Clauses (SCCs) for international data transfers.
  • If you do not consent to your data being stored or processed in the United States, you must not use the Application.

4. Intellectual Property

All content and features of the Application, including text, graphics, and software, are the property of Hanzi Flow or its licensors. Unauthorized use is prohibited.

You are granted a limited, non-exclusive, non-transferable license to use the content and features provided by the Application solely for personal, non-commercial purposes.

All rights, titles, and interests in the Application remain with Hanzi Flow or its licensors.

4.1 Third-Party Content

The Hanzi Flow displays data from CC-CEDICT Chinese-English dictionary which is licensed under a Creative Commons Attribution-Share Alike 3.0 License.

5. Age Requirement

You must be at least 16 years old to use the Application. By using the Application, you confirm that you meet this age requirement.

6. Limitation of Liability

The Application is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties and liabilities, including but not limited to:

  • Errors or interruptions in the Application.
  • Loss of data or unauthorized access to user accounts.

To the fullest extent permitted by law, Hanzi Flow's total liability shall not exceed the total amount paid by you for the service in the last 12 months.

In no event shall Hanzi Flow be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

7. Governing Law

These Terms are governed by the laws of Poland. Any disputes arising from these Terms or the use of the Application will be resolved in the competent courts of Poland.

8. Changes to These Terms

We may modify these Terms at any time. Any changes will be posted on this page with an updated "Effective Date."

We will notify you of any significant changes to these Terms via email or through a notification within the Application.

Continued use after the changes will be considered as acceptance of the modified Terms.
